By using the website https://shoptimal.ca (the “Site”) or purchasing services from Shoptimal (“we,” “our,” or “us”), you agree to the following Terms of Service (“Terms”). Please read them carefully.

 

1. Services

Shoptimal provides marketing solutions including consultations, project-based Accelerators, and subscription-based services (Flex Plans). The scope, deliverables, and pricing of each service as described on our Site are for informational purposes only. Final pricing and scope, including any applicable taxes will be agreed upon in writing.

 

2. Use of the Site

You agree not to:

  • Use the Site for unlawful purposes.

  • Attempt to interfere with or disrupt our website or services.

  • Copy or reuse content without our permission.

 

3. Payments

  • Payments are due according to the plan or package selected.

  • Subscription services (Flex Plans) are billed monthly and may be upgraded, downgraded, paused, or canceled at any time.

  • No refunds are issued once services are delivered unless otherwise stated in writing.

 

4. Intellectual Property

All content on the Site (text, graphics, logos, images) is the property of Shoptimal or our partners. You may not reproduce or distribute it without written consent.

 

 

5. Limitation of Liability

Shoptimal is not liable for:

  • Any indirect, incidental, or consequential damages arising from use of our services.

  • Losses resulting from third-party platforms (e.g., Shopify, HubSpot, Google, Meta).

Our maximum liability is limited to the amount you paid for services in the 3 months prior to the claim.

 

6. Termination

We reserve the right to suspend or terminate access to services if you breach these Terms.

 

7. Changes to Terms

We may update these Terms from time to time. The updated version will be posted on this page with a new effective date.

 

8. Governing Law

These Terms are governed by the laws of Ontario, Canada.
